Do I need an attorney to buy or sell a home?

What happens if an estate does not go through probate?

Not all estates must go through the probate process. For example, a person may have transferred property outside the probate process by using a trust or joint tenancy. Some people may qualify for a small estate administration process if they have personal property of limited value. If a person dies without a will the laws of intestacy control and must be pursued in Surrogate's Court through an administration proceeding. Regardless, a probate or administration case will most likely need to be filed to transfer legal ownership of real property and certain other assets.
