Do I need an attorney to buy or sell a home?


While you are not legally required to have an attorney to buy or sell a home in New York, it is highly recommended that you do. Real estate transactions in New York can involve large transactions that may pose a substantial risk, and an attorney can safeguard your interests by preparing and reviewing contracts, inspecting titles, and assisting you with the closing process. If a dispute arises during the transaction, we can help resolve the dispute.

What happens if an estate does not go through probate?


Not all estates must go through the probate process. For example, a person may have transferred property outside the probate process by using a trust or joint tenancy. Some people may qualify for a small estate administration process if they have personal property of limited value. If a person dies without a will the laws of intestacy control and must be pursued in Surrogate’s Court through an administration proceeding. Regardless, a probate or administration case will most likely need to be filed to transfer legal ownership of real property and certain other assets.
